Restaurant/waitress adds to credit card bill. what to do?

We went out for dinner at a restaurant that we have been going to for
many many years. this particular time we had a waitress that was WAY
short of acceptable. We left 0 tip. and before everyone goes nutz on me....we have 0 tipped a waiter/waitress maybe 4 times in over 40 yrs. and we eat out a lot. usually we leave 20% or more. I swear its harder on us than the waitstaff, we feel awful about having to do it.
Here's where things get strange..we get the credit card statement and there has been an addition of 20% to the bill! We email the owner who we have known for many years and she assures us that this is unlike
any of her employees to be dishonest and there must be some other explanation for this. The owner said she would have her partner look into it and get back to us. Today we get a call from the partner who tells us SHE did it!!! The waitress told the partner that we had taken all the receipts (we did not) and so they "just added it".
It seems this could be a couple things:
1. a dishonest server and the boss is covering for her
2. a dishonest server lying to her boss
3. the boss is part of it

So...what to do? we have had suggestions ranging from police report
for CC fraud to disputing the charge with the CC company.

Any thoughts/experiences from other frequent diners?
