Maybe this is not the proper place to post this question, but since it pertains to MA Law I thought it was the best place to ask.
MA law now permits patrons to bring home 1 bottle of unfinished wine when dining out. Is it discretionary on the part of the retaurant owner whether they will permit it? Went to dinner last night and the owner refused to allow my husband and I to take home the unfinished wine. Was it legal for him to say no when a state law says yes? I was irritated since we only ordered the bottle b/c we thought we could bring home the leftovers. But since he may well have been within his right to refuse and I did not know to the contrary, I did not put up a fight.
