Why Are Kinder Surprise Eggs Illegal In The US?

The Kinder Surprise Egg has been loved around the world since 1974. However, the U.S. Food and Drug Administration doesn't allow for its importation.
The FDA has determined the product doesn't conform to the 1938 Federal Food, Drug, and Cosmetic Act and is also considered a choking hazard.
Per FDA standards, Kinder Surprise Eggs violate the act since any "confectionery having partially, or completely imbedded therein, any non-nutritive object is adulterated."
As for the candy egg’s potential as a choking hazard, there have been a tiny number of incidents over the years. Travelers still try to bring the candy into the U.S.
