Today I posted, in a topic in the cookware board, describing 2 of 3 wooden spoons as being branded. The topic subsequently was deleted. By branded I meant burnished as in branding cattle. The OP wanted to make these spoons.
The wooden spoons have a circled capital R followed by a name in a specialized font. It was registering the look and feel of the name, not the spoon. We see all sorts of cookware that in look and feel, are, for all intents and purposes, close to identical. If someone copies exactly, not including a registered trademark, is it in violation of some code in law. If the copy is not exact, is it not a copy and therefore legal. I'm thinking specifically of wooden spoons. Can one even copyright spoons which have been around as long as man?
